Welcome to alyielts.com (“the Website”). The following Terms of Service (“Terms”) govern your use of the Website and the services provided by Bardai Educational Services (“we” “us” “our” “Bardai”). Any changes to these Terms of Service will take effect immediately from the date of publication.

Condition

If you (“user”) do not agree with the Terms, you are prohibited from using this website. We reserve the right to change, modify, add or delete to this Terms of Service agreement without notifying you. Please check back here periodically for updates before you use the Website.

Overview and Disclaimer

The website contains English as a Second Language (ESL) learning resources including custom IELTS preparation practice and assessment material. Users can purchase access to resources through the process described in these Terms.  In addition, the website provides a tutor matching service to student users.  Student users may opt in to reserve live classes at a coffee shop in Vancouver, British Columbia.  Currently, we promote and organize live classes with independent contract ESL teachers from Vancouver, Canada.   

Bardai is in no way associated with IELTS or any of its parent organizations or affiliated companies.  We operate this website, the licenses for all of the courses offered for sale on the Website and any sales and advertising, including the promotion of teachers of the Website teacher directory, contained on this Website.

AlyIELTS.com Website Account 

You must have an account to purchase and access some content on the Website.  When setting up and maintaining your account, you must provide a valid email address. 

You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission.  You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. 

You may not share your account login credentials with anyone else. You are responsible for what happens with your account.  You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other breach of security) by contacting AlyIELTS.com admin staff  We may request some information from you to confirm that you are indeed the owner of your account.

You must be at least 18 years of age to create an account on the Website and use the Services. If you are younger than 18 but above the required age for consent to use online services where you live (for example, 13 in the US or 16 in Ireland), you may not set up an account.  If we discover that you have created an account that violates these rules, we will terminate your account.

Payment Options

Subscription Access to Website Content

The Website offers both paid and free access to IELTS preparation blog posts and lesson resources.  In order to access payment forms, you must have a free account on the Website and be logged in.  Please read the details in the Account section presented in these Terms of Service.  

During your paid subscription to a module or course, you get a limited, non-exclusive, non-transferable license from us to access and view the content included in that payment option plan.  You may not transfer, assign, or share your subscription with anyone else.

To subscribe to get access to learning resources , you must provide a payment method. All paid subscription access is processed through Stripe, which is the payment processor used on the Website.  If we or the payment processor are unable to process payment through the payment method that you have provided, or if you file a chargeback disputing charges made to your payment method and the chargeback is granted, we may suspend or terminate your subscription.  

The subscription fee will be listed on the product page at the time of your purchase.  Payments are non-refundable unless otherwise stated on the refund page.   

Live Classes with a Tutor

In addition to paid subscription access to some content on the Website, we offer to connect you to an independent tutor contractor who can teach live training sessions at a public coffee shop.  Currently, we offer tutor connections and live class schedule bookings in the Metro Vancouver area only.

Let it be expressly emphasized that Bardai does not employ teachers.  The website offers a subscription membership to local English as a Second Language teachers in cities and towns in Canada in exchange for promotion and organization of a class schedule with students who wish to prepare for class.  Therefore, it is at your risk that you take a live class in a public coffee shop to assess your language skills.   You agree that by signing up for classes with a teacher through the sign up form on the Website that you hold Bardai Educational Services free from any liability.  You also agree to abide by the rules and agreement presented on the application form itself before securing your live class schedule with your payment method. This will include up to date information on the cancellation and refund policy for classes. 

Copyright Notice

All of the blog posts on the Website have been written and produced by Aly Bardai, who is a contract course developer (“Content Creator”).  His lessons have been written specifically for the AlyIELTS.com website.

We reserve exclusive rights and permission from the Content Creator to sub-license this content to you, the user.  You are not permitted to modify, copy, prepare derivative works of, decompile, or reverse engineer any of the learning resources you see on the Website, which includes images, logos, motion picture, PDF documents  and sound that you find in the Website content.

A Mark is a trade name reserved exclusively for use by Bardai.

Bardman Khan and Darby Laai are reserved exclusively for use by Bardai.  Any use of these names by you are strictly prohibited.

“Prepare Feedback Train” is a trade slogan reserved exclusively for use by Bardai.

“Pushing you to complete” is a trade slogan reserved exclusively for use by Bardai.

“Go for green flags” is a trade slogan reserved exclusively for use by Bardai.

No warranties

The Website is provided “as is,” with all faults, and we make no express or implied representations or warranties, of any kind related to this Website or the materials contained on this Website. Additionally, nothing contained on the Website shall be construed as providing consultation or advice to you.

Content Disclaimer

All of the lesson exercises, extra notes, video questions, video explanations and online and training session materials are solely intended as a preparation aid for the official exam. By using these materials, you release us from any responsibility regarding the accuracy or relevance of these materials in relation to the official exam.

We are not liable for any loss of time or money if you take the test and do not achieve your score or progress as fast as you think you will. By using this Website, you release us from all responsibility for your academic progress.

Termination of Accounts

We may at its sole discretion without penalty terminate any account you have with the Website including your user profile at any time with or without notice. We will not be liable for any losses incurred to you either before or after termination of your account.

Limitation of liability

In no event shall Bardai, nor any of its officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Website, whether such liability is under contract, tort or otherwise, and Bardai, including its officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

Indemnification

You hereby indemnify to the fullest extent Bardai Educational Services from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.
